Quotations for installation work may be provided by phone, email or in person. These quotations are budgetary unless explicitly confirmed in writing as being final.
Once the budgetary quote is accepted by both the customer and Boundless Power Systems LLC, an installation appointment will be scheduled. Payments for orders that include services, e.g. equipment installation, may require a deposit at the time we accept your order. This deposit confirms the customer is in agreement with the scope as outlined in the quotation and these terms in full. Payment Terms for installation services:-
Electronic invoices will be sent for payment. We accept payment by echeck (direct from bank account) and via credit card for a 3% fee. You represent and warrant that (i) the payment information you supply to us is true, correct, and complete, (ii) charges incurred by you will be honored by your financial institution, and (iii) you will pay charges incurred by you at the posted prices, including any applicable taxes. We may collect payment information directly from you, or we may choose to partner with third-party payment processors. Third-party payment processors have access to your payment information as needed to perform their functions.
On the scheduled installation day, the quote and scope will be reviewed and approved with the customer during a walk around prior to starting work. Any changes that are required during installation will be reviewed with the customer via email, phone or in person prior to proceeding.
Boundless Power Systems LLC will endeavor to satisfy any agreements made relative to scheduled installation date and planned installation duration but will not be deemed to be in breach of these terms or any agreements made due to a Force Majeure Event. A “Force Majeure Event” means Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout, failure in the transportation of equipment, machinery or personnel or in the provision of any utility including power, gas, water, or communication services; and in case of economic recession.
Equipment installed may be covered by a manufacturers warranty. To obtain warranty service for defective products please follow the instructions included in the manufacturer’s warranty.
Installation work completed by Boundless Power Systems LLC is covered for 12 months from installation date. If any defects in workmanship or materials is found, contact Boundless Power Systems LLC for warranty coverage support. Boundless Power Systems LLC will review the warranty claim and if the claim is deemed to be valid, Boundless Power Systems LLC will repair or replace the defective installation scope at its discretion.
UNDER NO CIRCUMSTANCES WILL BOUNDLESS POWER SYSTEMS LLC OR ITS AFFILIATES OR SUPPLIERS BE LIABLE OR RESPONSIBLE FOR ANY LOSS OF USE, INTERRUPTION OF BUSINESS, LOST PROFITS, LOST DATA, OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF BOUNDLESS POWER SYSTEMS LLC OR ITS AFFILIATE OR SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
YOU AFFIRM THAT BOUNDLESS POWER SYSTEMS LLC SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY BREACH OF WARRANTY CLAIMS OR FOR ANY DAMAGES ARISING OUT OF THE MANUFACTURER'S FAILURE TO HONOR ANY APPLICABLE WARRANTY OBLIGATIONS TO YOU.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you. Neither Boundless Power Systems LLC nor its affiliates or suppliers will be held liable or responsible for any damage or loss to any items or products connected to, powered by or otherwise attached to the Product. The total cumulative liability to Customer, from all causes of action and all theories of liability, will be limited to and will not exceed the purchase price of the product or Installation service paid by the Customer. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.
